Brand Name Nerd, LLC (“Brand Name Nerd,” “BNN,” “we,” “us,” or “our”) operates brandnamenerd.com. We are a New Orleans graphic design studio serving small businesses, creatives, nonprofits, and community organizations.

This Privacy Policy explains what information we collect through our website, how we use it, when we share it, and the choices available to you.

Information We Collect

Information you provide

We may collect information you choose to provide through contact forms, project inquiries, email, scheduling links, sponsorship submissions, or other website interactions, including:

Business or organization name
Email address
Phone number
Project details
Budget or timeline information
Website, platform, or technology details
Sponsorship materials you provide (such as a logo or image and website link)
Any other information you include in your message

You do not need to provide more information than is reasonably necessary for us to respond to your inquiry.

Information collected automatically

Our website may collect limited technical and usage information automatically, such as:

Browser and device type
Pages viewed
Approximate location based on IP address
Referral source
Date and time of visits
Interactions with forms, pages, or emails

This information may be collected through cookies, analytics tools, and other tracking technologies provided through HubSpot or related service providers.

Payments and checkout information (Stripe, through HubSpot checkout)

BNN uses its HubSpot-hosted checkout to accept payments, and card payments are processed by Stripe, including recurring subscriptions made through HubSpot checkout.

Payment card details are entered directly with the payment processor and are not received or stored by BNN.

BNN receives transaction and customer details such as name, email, business name, amount paid, product or placement purchased, and billing history.

Stripe’s own privacy policy applies to information Stripe collects. HubSpot’s Privacy Policy and Cookie Policy also apply to information HubSpot collects through its hosted pages, forms, CRM, cookies, analytics, marketing tools, and checkout. See HubSpot’s Privacy Policy and Cookie Policy.

Recurring subscriptions

Some purchases renew automatically, including Office Hours and monthly sponsorships.

BNN keeps records of subscription status, renewal date, cancellation requests, and payment failures in order to administer the subscription, process cancellations, and maintain financial records.

Ko-fi tips

BNN accepts optional tips through Ko-fi.

Ko-fi processes the payment and collects the tipper’s name, email, and payment details directly. Tips do not purchase any goods, services, placement, or deliverable in return.

Sponsorships and published material

Sponsors may provide a logo or image, business name, and website link.

BNN publishes the sponsor’s logo or image, business name, and link on the public site. We use the business name as alternative text for screen readers.

Sponsor materials are published publicly on purpose. They are not confidential, and they may be archived with the dated record of each published version of the sponsorship terms.

BNN retains sponsor contact and business details in its CRM for as long as the sponsorship is active, and afterward as needed for financial records, placement history, and sponsor seniority.

Scheduling and session records

Discovery calls and Office Hours sessions are booked through a scheduling link provided with the payment receipt.

The scheduling provider collects the client’s name, email, and booking details, and may send confirmations, reminders, and calendar invitations.

Sessions are not recorded or transcribed unless both parties agree in writing before the session, consistent with the Office Hours Terms.

HubSpot, CRM, Cookies, and Analytics

Our website uses HubSpot-hosted pages and forms and may use HubSpot CRM, analytics, cookies, and marketing tools.

HubSpot may place cookies or similar technologies on your device to help us:

Operate and secure the website
Remember preferences
Understand how visitors use the website
Track form submissions and inquiries
Organize contact and client records
Measure email or marketing activity
Improve our website, services, and communications

Some HubSpot tools may connect website activity with a contact record when you submit a form, communicate with us, make a purchase, or otherwise identify yourself.

Cookies may remain on your device for different periods of time depending on their purpose. You can adjust cookie settings through your browser. Blocking or deleting cookies may affect some website features.

To limit analytics cookies, you can use your browser’s cookie controls (including blocking third-party cookies), clear cookies, or use privacy-focused browser settings or extensions. If HubSpot provides a cookie banner or preference tool on our site, you can also use it to set your choices when available.

Our Free HTML Tools

BNN may offer free HTML tools that run entirely in your web browser.

When you use one of these tools:

The tool processes your input in your browser.
The tool does not save your input to BNN’s servers.
The tool does not transmit your input to BNN for storage or analysis.
BNN does not receive or retain the information entered into the tool.

Your browser, device, browser extensions, network provider, or other third-party software may still handle information according to their own settings and policies. If you separately submit a contact form or send us an email, that communication is handled as described in this Privacy Policy.

How We Use Information

We may use collected information to:

Respond to questions and project inquiries
Schedule discovery calls or follow-up communications
Understand your design, branding, website, or technology needs
Prepare proposals, estimates, and agreements
Provide design, copywriting, website, print, or technical services
Maintain client and business records

Publish sponsorship placements as requested and purchased

We do not use information collected through the website to make decisions about a person’s eligibility for employment, housing, credit, insurance, or similar services.

When We Share Information

We do not sell your personal information.

We may share information when reasonably necessary to operate BNN and provide services, including with:

HubSpot (including HubSpot CRM, website hosting, forms, analytics, marketing tools, and checkout)
Stripe (which processes card payments, including payments made through HubSpot checkout)
Ko-fi (for optional tips processed through Ko-fi)
Our scheduling provider (used for booking discovery calls and Office Hours sessions)
Email and productivity providers, such as Google Workspace or Microsoft 365
Cloud storage providers used for business file storage and collaboration
Print shops, production vendors, or other project partners when needed to complete approved work
Professional advisors, such as accountants, attorneys, or insurers, when appropriate
Government authorities or other parties when required by law, legal process, or to protect rights and safety
A successor or purchaser in connection with a business transfer, merger, restructuring, or sale

Service providers may process information on our behalf under their own agreements and privacy policies.

We do not provide client contact information to unrelated third parties for their own marketing purposes.

Data Retention

We retain information for as long as reasonably necessary for the purpose for which it was collected, including to:

Respond to an inquiry
Complete a project
Maintain client and financial records
Maintain payment and subscription records
Maintain tax and accounting records
Maintain cancellation and refund records
Maintain sponsorship placement history (including dates, placements, and versions)
Resolve disputes
Enforce agreements
Meet tax, accounting, legal, or insurance requirements
Manage marketing preferences

When information is no longer reasonably needed, we may delete it, anonymize it, or securely archive it. Information stored by HubSpot or another service provider may remain subject to that provider’s retention and deletion procedures.

Your Choices and Rights

Depending on where you live and the law that applies, you may have the right to:

Ask whether we maintain personal information about you
Request access to personal information we maintain
Ask us to correct inaccurate information
Ask us to delete information, subject to legal or business-record exceptions
Withdraw consent where we rely on your consent (such as optional marketing communications)

You can unsubscribe from marketing emails by using the unsubscribe link in the message or by contacting us directly.

To make a privacy request, email hi@brandnamenerd.com with the subject line Privacy Request. We may need to verify your identity before completing a request. We will respond within a reasonable period and as required by applicable law.

Deleting information may not remove records that we are required or permitted to retain for legal, accounting, security, dispute-resolution, or contractual purposes.

Marketing Communications

We may send occasional updates about BNN services, resources, workshops, or related creative topics when permitted by law and when you have consented or otherwise authorized those communications.

You can opt out at any time. Opting out of marketing does not affect project-related, transactional, or administrative communications.

Data Security

We use reasonable administrative, technical, and organizational measures intended to protect information we maintain. No website, email system, cloud service, or method of transmission is completely secure.

Please avoid sending highly sensitive information through a website form or ordinary email unless we specifically request it through an appropriate secure process.

AI Tools and Your Materials

BNN does not submit client logos, brand assets, session materials, or confidential information to AI tools for training, fine-tuning, dataset construction, or use as a style reference.

Children’s Privacy

Our website and services are not directed to children under 13. We do not knowingly collect personal information from children under 13 through our website.

If you believe a child has provided personal information to us, please contact us at hi@brandnamenerd.com. We will take reasonable steps to delete the information.

Third-Party Links

Our website may link to third-party websites, platforms, portfolios, vendors, social media accounts, or other resources.

We do not control those websites or their privacy practices. Information you provide directly to a third party is governed by that third party’s terms and privacy policy. We encourage you to review those policies before submitting information.

Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our website, services, technology, vendors, or legal obligations.

When we make changes, we will update the effective date at the top of this policy. Your continued use of the website after an updated policy is posted means that you have reviewed the updated policy.
